Australian Government: No Legal Reason To Use Encrypted Messengers

Criminals use encrypted messengers in order to hide their identity and not get caught by law enforcement officers.

The Australian Criminal Intelligence Commission (ACIC) believes that there is no need for a law-abiding member of the public to use encrypted communication platforms.

“Platforms like these are used almost exclusively by organized crime groups and are designed specifically to hide the identity of the criminals involved and enable them to evade detection by law enforcement. They allow communication in closed networks and facilitate the implementation of criminal activities, ”explained ACIC.

The comments are in a document filed with the Parliamentary Joint Committee on Intelligence and Security (PJCIS) as part of the 2020 Surveillance Legislation Amendment (Identify and Disrupt) Bill revision.

The mandate granted to ACIC under the bill will focus on understanding and gathering information on criminal groups using encrypted communication platforms to conceal criminal activity.

If the bill is passed, the Australian Federal Police and ACIC will be able to receive three new online crime warrants: a data change warrant, a network activity tracking order, and an account control interception warrant.

The warrants complement ACIC's existing mandate by providing new capabilities for collecting information and responding to serious online crime. ACIC believes the bill addresses gaps in the current powers of electronic surveillance.

"This will play a decisive role in uncovering the identities of anonymous criminals, as well as in collecting evidence of the initiation and commission of serious crimes on the Web, including on the darknet, which uses encrypted communication platforms," the message says.
